General terms and conditions

1. Introduction

The general terms and conditions of sale detailed below govern the contractual relationship between the User (hereafter referred to as You) and the Bestwinesshop.com company (hereafter referred to as We) belonging to the company Best Wines Shop SL, whose headquarters is situated at Joanot Martorell, 22 Torre de Claramunt 08789 Barcelona (SPAIN) and registered on the register of companies and commerce in Barcelona under the number B64719073. Both parties accept these conditions unreservedly. These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. We maintain that, by confirming your order, you unreservedly accept our general conditions of sale, having read them. These Terms and Conditions of Sale are important to you and Bestwinesshop.com as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between us.

2. Ordering

There are 2 methods in place to put through an order:

We will then send you a confirmation by e-mail that we have received your order. We will keep you informed all the time about your order status, payment process and any other issue until the goods are shipped to you from our warehouse. You can check at any time the status of your pending shipments at UPS web site

3. Product information

Bestwinesshop.com takes great care when putting information on-line with respect to the essential characteristics of our products, notably with respect to the technical descriptions emanating from our partners and suppliers and the photographs illustrating the products. In some cases the accessories contained in the bundles sold by Bestwinesshop.com.com could be compatible brand accessories and not manufacturer’s brands.

4. Prices

The prices indicated on the website are in Euros and include all taxes but do not include delivery. The chosen possible delivery costs are indicated for the User during the product selection, and depending of the amount of the order and are invoiced or not at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment but will apply the current rates as indicated to you on the site at the time the order was placed.

5. Availability

All items offered on our website are subject to availability. The stock you see in the website is constantly updated every few minutes, but if you do order an item and it is out of stock we will notify you within 1-2 working day of your order being placed. At that point we will advise you of the likely time scale of any delay, you can then decide to either wait for the item to come in to stock, or cancel your order. We will offer you as a replacement for an unavailable product, a product of equal price and quality.

6. Delivery methods

Best Wines Shop will send you the goods using Mail Boxes Etc (a UPS Company) services, that is one of the most recognized and safe shipment service providers of the world. All the bottles are sent with a special UPS box to protect it as much as possible. All the deliveries have insurance in case of the bottle breakage. We ship to all CEE countries, Asia, USA and Australia. You will be informed by e-mail of any step of your order processing and after leave our warehouse you will be able to fully track it in the UPS website. We generally expedite a paid order within the next 2 business days. International orders are generally received in less than 7 business days. European orders between 2 and 4 days. We ship an order exclusively in packages for 1, 3 or 6 bottles.

Your order will be delivered to the address you indicated when you placed your order. Signature may be required upon delivery to your address. You are responsible for your order once the package arrives at the supplied delivery address. We cannot be held responsible if the package/s goes missing once delivered. If any goods are received faulty or damaged you must notify us within 7 days of receiving them (via email to: info@Bestwinesshop.com) quoting your order reference. We cannot be held responsible for goods that do not arrive with the customer due to errors made by the customer when entering their address details. Please ensure that you double check all your details before confirming your order. Upon reception of your order, we recommend that you verify your products with the order that you placed with us and if necessary, write any anomalies that may have occurred on the delivery voucher, not forgetting to sign it. Without prejudice and with respect to the applicable legal guarantees, we recommend that you address any reservations you may have pertaining to malfunctioning products on the date of delivery as quickly as possible by e-mail: info@Bestwinesshop.com

Returned products can only be accepted for products in their original state, notably with respect to their packaging, accessories and manuals. In the event of non-conformity of the product purchased, the User will have the choice between repair and replacement of the product, except if the desired option has an associated cost that is manifestly disproportionate to the alternative.

We would like to inform you that a delay of 24 hours is possible for delivery of your order. In fact, for security reasons, all orders paid by bank card are verified by Bestwinesshop.com. Complementary information may be requested, or demanded, in order to validate your purchase.

By consequence, and in trying to avoid any delay, when you place your order please enter the following: - a professional or paid-for e-mail address - a land line telephone number (work or home) where you can be reached at any time of the day Furthermore, for any order above the amount established by Bestwinesshop.com, a piece of ID as well as proof of address will be requested and should be sent via fax, Post, or e-mail. We apologise for any inconvenience this may cause; however, these measures are taken to protect our clients from possible fraud associated with bank cards. Forms of ID required for payments by Credit or Debit Card: - A valid form of ID (passport, driver's licence, etc..) of the credit card holder, as well as the credit card used for payment, will be required. If the person who picks up the goods is not the credit card holder, these same documents will also be requested.

7. Secure payment

Bestwinesshop.com offers 1 methods of payment at the moment: Credit card (Debit card, Visa or MasterCard) When you pay by credit card, your account will be debited when your order is forwarded, on condition that we have received pre-authorisation for your account. If sufficient funds are not available, your order will not be taken into account. For payments made on-line by credit card, the “Secure Socket Layer” (SSL) system of security is used, which allows for encrypting your banking information when on the network.

8. Right of Retraction - Satisfied or your money back

Bestwinesshop.com allows you 30 working days to return a product that you are not satisfied with. You can return the product within this time period, at your own expense, accompanied by your invoice and a completed and signed return goods voucher. We request that you send us the merchandise by registered post and that you purchase insurance with the carrier for the value of the merchandise. This is notably necessary should they lose or damage the goods. Shipping fees remain the customer’s responsibility. The present right of return only applies to products that are returned in their original, complete working condition (packaging, accessories, user guide etc.). Any product that has been damaged, or is not in its original packaging, or has packaging that has been worn beyond simply opening the product, will not be refunded. For reimbursements: User will be reimbursed by bank transfer. If tests need to be carried out on the product, in the framework of the right of retraction, Bestwinesshop.com will do its best to reimburse the User as quickly as possible. This time period will depend on the nature of the technical tests performed by the After-Sales Service of your product’s manufacturer, for a maximum period of 3 weeks. Your product must be complete and in ‘as new’ condition (i.e. if you have opened the box to examine the product you must have done so without damaging or marking the product or packaging). It must not have been used or installed. It should be returned with the original box, packing and accessories you received with it. By following the steps above you will receive a full refund for the price of the product and any delivery charges paid.

9. Returns

All products except: Software products please note that shipping fees are the client’s responsibility, except if the product does not conform to the description of said product (the client is responsible for any damage done during the shipping of the returned goods). 10. Guarantees and After-Sales Service

All of the products we sell benefit from:

* The legal guarantee of conformity; * The legal guarantee from hidden flaws; * The manufacturer’s guarantee for a period defined by the product purchased and the brand.

Shipping fees of the products are the customer’s responsibility. However, if the product does not conform to the product description, shipping fees will be reimbursed to the customer. For any returned package, please contact us at info@Bestwinesshop.com and follow our return policy instructions. Bestwinesshop.com will handle possible repairs with the manufacturers. Whatever the problem is with your product, you must attach, with the defective product, a copy of your invoice, the guarantee (in the box) and the return goods voucher. Please note that legal guarantees do not apply to repairs for damage caused by external origin (for example, accidents, shocks, fluctuation of electricity etc.) or by the user’s faulty usage of the product such as a non-conforming installation or using it for commercial purposes or using said product with incorrect peripherals, accessories or consumables.

The manufacturer’s guarantees sold by Bestwinesshop.com do not cover:

* Replacement of opened wines * The abnormal use or non-conforming usage of products. * Damage from external sources (shocks, accidents, etc.).

In all cases, Bestwinesshop.com will not be held responsible in the event that the manufacturer refuses to honour the warranty due to, but not limited to, any of the above noted reasons. In the event where the manufacturer will not provide service under warranty, an estimate of the cost of the repair will be given to the customer.

Administrative fees will be requested if payment for the estimate is not made. If the User agrees to the estimate, a cheque will be issued to Bestwinesshop.com and will correspond to the estimate amount, and ought to be sent to us.

Faulty goods If there is a fault with your product (or other defects with your order), we will normally offer a prompt repair, exchange. You will always have the option of an exchange or refund if the fault occurs within 30 days of delivery.

In all cases we reserve the right to inspect the product and verify the fault. To qualify for a refund or exchange the product must be:- In “as new” condition, and- Complete, with any accessories and free gifts offered with it (and, if possible, the original box and packaging).

This guarantee does not cover faults caused by accident, neglect, misuse or normal wear and tear. Any refund due to a fault or other defect will include a refund of the applicable delivery charge. We will also pay for our costs of collecting goods for replacement or refund. Replacement goods are sent by standard delivery only.

12. Protection of personal data

Since the details you give us are essential for the processing and delivery of orders, for billing and for the establishment of warranty contracts, failure to provide these details will result in the cancellation of your order.

Communicating false information is contrary to the present General Conditions as well as the conditions of use listed on the Site.
